ReplyDeletethe 2nd amendment has loooong been debated and argued about over its intent and what exact rights it grants the individual. the decision has been made to allow any citizen to bear arms by the courts, so its a done deal, but the debate rages on.
ReplyDeletethat decision was won based mainly on the phrase "the right of the individual to bear arms shall not be infringed". seems straight forward and easy, until you read the part about "the right of the states to maintain a well regulated militia", because that certainly clouds the issue. opponents believe the intent of that amendment was to allow the individual states to maintain some form of armed presence to alleviate concerns that they had around the possibility of a tyrannical federal government arising, and to make it easier for the states to join in a union. join in a union. join in a union. more than it was to allow an individual to pack heat in a nightclub.
regardless, the phrase "well regulated" DEMANDS that laws around the ownership and use of such weapons be in place and utilized, which to me makes any absolute argument about magazine size and machine guns foolish and unwinnable on a constitutional level.

I am certain that the USA has reached the point where a third party is needed. when you have 2 choices a split down the middle is inevitable, and stalemate and bad feeling results. there is real hate between the 2 sides, the issues have split my border straddling family fairly deeply, even.
